Recent analyses of public comments on the federal government's plan to move marijuana to Schedule III of the Controlled Substances Act (CSA) show strong support for broader cannabis reform. The majority of submissions favored completely removing marijuana from the CSA rather than just rescheduling it. Headset’s report reveals that 35% of comments supported the Biden administration’s plan to reschedule marijuana, but 57% argued for its full descheduling. Only 8% of comments recommended keeping marijuana in Schedule I.

The public response was unprecedented, with nearly 43,000 comments submitted, surpassing previous records. Most comments favored removing marijuana from Schedule I, and 69% supported decriminalizing or fully legalizing it. The Drug Policy Alliance (DPA) highlighted that 42% of comments called for reform to address racial justice and social equity. They argue that simply rescheduling to Schedule III would still leave individuals vulnerable to legal consequences and fail to address broader issues of racial disparity.

The comment period, which ended recently, has prompted calls for President Biden to take more comprehensive action on marijuana reform. Critics argue that a move to Schedule III would not fully resolve the issues of criminalization and its impact on marginalized communities.
